How to Effect the Technological and Legal Defeat of Dodd vs Jackson
This is a holy war.
I believe that it’s only a matter of time before the ruling of Dodd vs Jackson will reach its ultimate demise, if not in law, then at least in spirit. Abortion rights are supported by a majority of Americans across the land and opposed in small states with religious majorities. In a test of wills, the majority is likely to prevail.
The polling is clearly in favor of women’s reproductive rights, and it has been fairly consistent for decades. The Moral Minority is not thinking that clearly about the majority. They seem convinced that imposing their will upon the majority is their passage to heaven.
As much as I may disagree with conservatives and Republicans in general, I have to admit that I admire them for their willingness and capacity to get things done. In the 50 years since Roe was decided, Democrats have had opportunities to codify Roe, and did not. I can’t imagine why not.
The saving grace of this Court is that they did leave the matter to the people. They could have said that abortion is illegal in a way that could be very difficult to overrule. The Justices could have made a ruling so odious as to prohibit any law that protected a right to abortion. They did not.
